Terms of Use

1. Who can use Fueled by Shirley

You must be at least 18 years old and able to form a binding agreement.

2. Nutrition guidance, not medical advice

Fueled by Shirley provides general performance nutrition guidance for healthy adult athletes. It does not diagnose, treat or prevent any medical condition, and it is not a substitute for advice from a physician or other qualified clinician who knows your circumstances.

Talk to your physician before changing how you eat or train if you are pregnant or breastfeeding; have diabetes, a heart, kidney or gastrointestinal condition; take medication affected by diet; have a current or past eating disorder; or have been told you have low energy availability or relative energy deficiency in sport (RED-S).

Targets and estimates in the app are calculated from the information you and your connected services provide, and they can be wrong. Stop and seek medical help if you feel unwell.

Using the app does not by itself create a dietitian–client relationship. That relationship exists only if you separately agree to work with Shirley Plotnik as a client.

3. Your account and information

Keep the information you enter accurate, because your targets depend on it. You are responsible for keeping your sign-in details secure and for activity under your account.

4. Connected services

When you connect a service such as Strava, its own terms and privacy policy also apply. We are not responsible for the availability or accuracy of information provided by connected services.

5. Acceptable use

Do not misuse the service: no attempting to access other people’s accounts or information, interfering with how the service runs, or copying or reselling it.

6. Our content

The app, its calculations, design and content belong to SP Nutrition Group LLC. You may use them for your own training and nutrition.

7. Early access

Fueled by Shirley is in early access. Features may change, be limited or be withdrawn, and we may pause or end the service.

8. Disclaimers

Fueled by Shirley is provided as it is. We do not promise that it will be available without interruption, that it will be free of errors, or that it will suit any particular person or purpose.

Every target the app produces is an estimate, calculated from what you and the services you connect tell it. That information can be wrong, stale or incomplete, and the estimate is then wrong with it — wrist-worn devices commonly misreport energy by a fifth or more, and a training threshold that is out of date carries its error into everything worked out from it. What the app shows is a considered starting point, not an instruction to follow without thinking.

Section 2 applies in full, and nothing in this section excludes a warranty or a right that the law where you live does not allow us to exclude.

9. Limitation of liability

Some things cannot be limited and we do not try to. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else the law where you live does not permit us to exclude.

Subject to that, we are not liable for indirect or consequential loss, for lost profits or earnings, for training time or competition missed, or for loss of information you could have exported and kept a copy of at any time.

Subject to the first paragraph of this section, our total liability to you for everything arising out of or relating to Fueled by Shirley is limited to the greater of what you paid us in the twelve months before the claim arose and US$500.

If you are a consumer, the law of the country you live in gives you rights that these terms do not affect and that nothing here asks you to give up.

10. Ending your use

You can stop using Fueled by Shirley and ask us to delete your information at any time. We may suspend or end access if these terms are broken.

11. Governing law

These terms are governed by the laws of Florida.

12. Changes to these terms

When we change these terms we update the date at the top. If a change is significant, we will tell you by email before it takes effect.
